DUI PENALTIES
First Offense DUI Penalties
- A fine of $300 to $1000
- 10 days to 12 months in custody; judge may suspend all but 24 hours
- 40 hours of community service
- Completion of DUI Alcohol or Drug Use Risk Reduction Program
- A clinical evaluation and, if recommended, completion of a substance abuse treatment program
Second Offense DUI Penalties
- A fine of $600 to $1000
- 90 days to 12 months in custody; judge may suspend all but 72 hours
- 30 days minimum of community service
- Completion of DUI Alcohol or Drug Use Risk Reduction Program
- A clinical evaluation and, if recommended, completion of a substance abuse treatment program
Third Offense DUI Penalties

- A fine of $1000 to $5000
- 120 days to 12 months in custody; judge may suspend all but 15 days
- 30 days minimum of community service
- Completion of DUI Alcohol or Drug Use Risk Reduction Program
- A clinical evaluation and, if recommended, completion of a substance abuse treatment program
- A third offense DUI is considered an aggravated misdemeanor
Felony DUI
A fourth-offense DUI and greater is a felony, with increasing penalties.
Fourth Offense DUI Penalties:

- A fine of $1000 to $5000
- One to five-year sentence, minimum of 1 year in custody
- 60 days minimum of community service
- Completion of DUI Alcohol or Drug Use Risk Reduction Program
- A clinical evaluation and, if recommended, the completion of a substance abuse treatment program
